A 44-year-old Colorado man who sexually assaulted a teenage girl has learned his fate for sexually assaulting a teenage girl — after claiming at trial he couldn’t have committed the crime because his genitalia was too small.

When police interviewed Berg about the allegations, Berg told officers he was “unable to have sexual intercourse due to the size of his belly fat and small size of his genitalia,” the DA’s office said.

“He also claimed he had an alternate sexual orientation which made him disinterested in the conduct alleged,” the statement continues, noting that Berg maintained those claims when testifying at his trial.

The victim also accused Berg of physically abusing her: she bore a 4-inch scar on her back that she said was the result of Berg scratching her with a fork. On another occasion, the victim alleged he even branded her arm with a knife he had heated up on a stovetop, etching the initials “RB” for Brandon and his wife, Rebecca, the victim’s biological mother.
